4. SMS / Text Message Communications and TCPA Consent

If you provide your phone number through an Atria Real Estate Group form or directly to one of our agents, the following applies to any SMS / text message communications you may receive from us.

4.1 Two Separate SMS Consents

Our forms separate two distinct SMS consents into two checkboxes:

• Transactional SMS consent — checking this box authorizes us to text you about your specific real estate inquiry, including showing confirmations, listing updates, document signing notifications, closing process updates, and direct responses to your questions.
• Marketing SMS consent — separate, optional. Checking this box authorizes us to text you with new listing alerts, open house notifications, market updates, price reduction alerts, and seasonal real estate tips.

You may opt in to one without opting in to the other. Neither SMS consent is required to use our services, request information, or work with us. Both consents are recorded with date, time, and the page where consent was given for TCPA documentation.

4.2 Message Frequency, Rates, and Carriers

Message frequency varies based on your activity. Transactional messages are sent as needed in response to your requests. Marketing messages are typically sent 2–4 times per month. Standard message and data rates from your wireless carrier may apply. Atria Real Estate Groupis not responsible for carrier charges. Carriers (T-Mobile, AT&T, Verizon, and others) are not liable for delayed or undelivered messages.

4.3 Opting Out

4.4 A2P 10DLC and Eligibility

The numbers we use to text business contacts are registered with U.S. wireless carriers under the A2P 10DLC framework, meaning our messaging traffic is identified, vetted, and rate-limited per carrier rules. SMS to non-U.S. numbers is not supported. You must be 18 years of age or older to opt in to our SMS program. By opting in, you confirm that you are at least 18 and the account holder or authorized user of the mobile number provided.

4.5 SMS Data Sharing — No Sale, No Sharing for Third-Party Marketing

Your phone number, your SMS consent, and your text message content will not be sold, rented, or shared with any third party for their marketing purposes — ever. Mobile information is shared only with the messaging infrastructure necessary to deliver the messages you consented to (our CRM provider GoHighLevel and its messaging sub-processors LeadConnector and Twilio), and with the brokerage and licensed agents working on your transaction. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All other categories of third-party sharing are excluded from your SMS opt-in data.
